A few things happened this week that make talk of any "do-over'' of the Florida and Michigan Democratic primaries pretty much history.

The Michigan legislature adjourned without authorizing a new primary election for the Democratst there, for lack of support from Sen. Barack Obama's presidential campaign. The Republican Florida governor has made it clear that the state won't be playing for any rerun there.

And today, a federal appeals court threw out the lawsuit of Florida Democrats attempting to overturn the ruling of the Democratic National Committee barring the state's delegates from the summer convention for holding early, January primary elections contrary to national party rules.

This likely returns the whole question of what to do about Florida's and Michigan's denied delegations over to the credentialling committee for the Democratic National Convention and the convention itself in Denver this summer -- when the question will either be moot, because "superdelegates'' will have rallied around either Sen. Barack Obama or Sen. Hillary Clinton, or the two states' delegations will become prime targets for a back-room deal. Either way, they probably ultimately will be seated -- either in silence, or amid great tumult.

A federal appeals court in Atlanta today dismissed a lawsuit against the DNC. Yet the U.S. Circuit Court of Appeals said the lawsuit “raises a number of interesting and potentially significant questions,” and gave the state party an opening to amend and refile the lawsuit.

Victor DiMaio, a Democratic Party activist from Tampa, said he would refile.

DiMaio filed the lawsuit last year accusing the party of disenfranchising Florida’s Democratss. The DNC argued that the party has the right to set its own rules and not seat delegates who refuse to follow them.

The DNC praised the decision.

"As two U.S. District Courts in Florida have found, and as the Supreme Court has consistently recognized, national political parties have a constitutionally protected right to manage and conduct their own internal affairs, including the enforcement of delegate selection rules,” the party said in a statement.

DiMaio too voiced confidence that a newly filed appeal might be successful.

"This is a big victory,” DiMaio, saying he is neutral in the presidential race, told the Associated Press. “As close as this election can be, these little votes can make a big difference in who could be the next president of the United States. That’s why I’m anxious and ready to go. And the clock is really ticking.”

I guess the real Obama is coming out more and more. WHy he is stopping Michigan from revoting. He wont let them sit their delegates but he will not let them revote so I guess if you live in Michigan your vote doesnt count. Has 1 campaign ever been torn apart more in 1 week then Obamas has. He went from the favorite to win the Presidency to having very little chance of ever becoming president. In politics it is amazing how quickly fortunes can change in such a short time.

Florida and Michigan need to learn how to follow rules. Break the rules, face the consequences. Stop whining, they knew this would happen and broke the rules anyway.


The American People (specifically Florida & Michigan who are angry with the outcome) are a joke! You create rules and get angry when people enforce them. This country deserves exactly what it gets. A failed economy, broken foreign relations, and an ever crippling moral stance. This country is full of a bunch of hypocrites and ran by one. If Obama doesn't have a chance of winning it is only because this country is not ready for someone who is as honest and morale and would rather elect politicians who lie and cheat to win!


Would Senator Obama feel as strongly about not seating the FL and MI delegates or re-running the disputed primaries if he had won them or stood a cat's chance of winning them? Would Nancy Pelosi be as adamant in denying the voters of two of the Nation's largest states their rightful voice at the Democratic convention if she did not owe the financing of her campaigns to Penny Pritzker, the Chicago billionaire who is Senator Obama's finance chief?

Both the Senator and the Speaker are quite happy to disenfranchise the Democratic voters of FL and MI. Remarkable how money talks.


The appeals court dismissed the appeal on the basis that the plaintiff did not suffer any particular harm and had no standing. However, since membership in the Democratic National Party, --a private organization, is voluntary, like all other organizations, members agree to abide by the rules and decisions of the higher-ups. So I'm not sure where they can go with this. I haven't thought it out that far...


The Obama campaign's not wild about the Clinton-supported plan for a Michigan do-over for pretty obvious reasons. Everyone who voted for Clinton would get to vote again, but those Obama supporters who took the DNC and both campaigns at their word, and voted in the Republican primary instead, are excluded.

That's not a "do-over" -- that's a "do-my-side-over-your-side-not-so-much." A real do-over, where everyone gets to start fresh, would have found much more support, but the Clinton camp members that proposed the half-do-over didn't want a fair fight, they wanted an easy win.

No surprise that they didn't get support for it, but it has nothing to do with disenfranchising Michiganders, and everything to do with trying to skew the results.


In what bizarro world is this the fault of the DNC?

Florida and Michigan made the decision to violate agreed on party rules and knew of the punishment in advance.

There is more at stake than this one election. Think it through.

What happens next election when 5-6 states who support 'canidate x' decide to stack thier primaries early to build momentum for their canidate?

I want to know why voters are not suing the real people responsible? Florida and Michigan representatives.

How come they havn't been fired?


FL and MI broke the DNC rules. Again FL and MI broke the DNC rules by moving their primary dates. Both states were aware of the consequences but they moved ahead anyway. Now one more time with me FL and MI broke the DNC rules. The reason MI won't get a revote because their law states that republicans and independents won't be allow to vote again.

The DNC could choose to honor Florida's votes. Clinton did not campaign there although she did hold a fund raiser. Obama ran a national television add in Florida. In Michigan they need to re vote because Obama was not on the ballet. If Clinton supporters want to pay for a primary we should let them. My vote is not for sale. Americans will vote their conscience. Obama with his vast resources could choose to let the people the of Michigan have their say. He could help cover the cost with his campaign money if he wanted to. Equal rights should mean having an equal right for everyones vote to count. This was taken away from the people of Florida and Michigan. It is not the residents of either of these states fault that the people they voted into office chose to move their date. Politicians need to place what is best for the American public over what is best for themselves. The only way to do this is to let every American's vote count. This does not mean we should divide the delegates. That is just another way of telling the people that their vote is meaningless. Each vote needs to count for the intended party. Obama should be ashamed of suggesting to do anything less than give each American a vote that counts.

Right you are. They, MI and FLA made their bed, now they should lay in it.

This is just one more reason for having a 'national primary election day'.


New Hampshire also broke the rules, moving its primary up. But NH wasn't punished.

Why is that, do you think?

Fool...8 more years of Bush, and it will be your fault.

Other wiser people; These so called undecided and independents are the problem. They have no clue what they believe and they will cut off somebody else's nose to spite some third parties face.


I think we live in the United States of America, not except for Florida and Michigan. This has become a joke and the DNC should be ashame for not letting these votes count. This is beginning to look like something that some third country would do to their people. It should never happen in the United States. This is a sad day for our country!


I think Richardson waited until now when the re-vote is out of the question to endorse OBama because it is a safer endorcement now that people can't vote for the nominee they want.

This election is a good argument to get rid of the 2 party system, as it is anything other than democratic.


It's funny how people play the rule game when it is expedient.


Thank goodness it is finally over. What Hillary had been pushing for is something akin to retrospectivity in law which is against the rule of law. She was once qualified as a lawyer so one would expect her to know but, no, Hillary dosn't play by rules. Not her.


You Clinton supporters who want to blame Obama for the FL & MI votes seem to have an issue with the truth...much like your candidate concerning NAFTA and her "experience"..or proven lack there of.
YOUR candidate Hillary Clinton signed a waiver to allow the voters to be disenfranchised. Period. BUT now that she needs tose votes she, and you, want to scream foul.
YOur own elected officals made the call with full knowledge of what would occur. If they did not learn what happens when you don't follow the rules in kindergarden then perhaps they are not fit to hold public office.

Clinton participated in Michigan while others did not. Uncommitted got 44% for goodness sakes.

Obama will abide by what occurs. But get real; this is politics also. He has a 2 score lead with time running out and you want him to PAY to put more time on the clock. He's not stupid and if he were to cave to this moaning he doesn't deserve the title "commander".

Michigan and Florida will be seated but not based on the past meaningless (for delegate purposes)results. Obama does not control the legislature of Michigan anymore than Clintons sugar daddies willing to pay for it do. Thay maade the problem worse as it appeared so improper as to send them running from a Clinton bought process.

Obama is not even worried about the results of a revote only the tipping potential of the "disenfranchised" superdelegates in the states. YAWN


This is only the PRIMARY we're talking about here people. It really is **the party itself** that gets to choose the candidate. Think about the whole SUPERDELEGATE system in place. For all you people living in FL or MI who are talking shit about Obama, I do empathize with you because your state leadership let you down, BUT QUIT BLAMING OBAMA FOR PLAYING BY THE RULES - HE DIDN'T CREATE THEM!!! Don't you see that Clinton is a true hypocrit here? For two huge reasons 1) She supported the superdelegate system more than anyone (of course because she thought it would help her chances), and that system gives very special treatment NOT to the voting public but to a few important politicians. 2) She originally agreed to the "rules" (that she then broke anyway!) and didn't raise a stink about it until it became clear that she might have something to gain personally from a revote. If she really cared about the voters of MI & FL, she should not have agreed to the rules and put up a stink way back when. SHE DIDN'T.

As I said, I do have empathy for your situation FL & MI voters, but its not fair to make Obama the scapegoat for what your representatives did in trying to move up the dates. I hope you think clearly about this, and get those people who made these dumb decisions for you OUT OF OFFICE. In the meantime, come fall - VOTE OBAMA 08'


The trouble is the decision to break the DNC rules was made by the state governments, but the voters are the ones who suffer. The DNC should have done whatever it could for the revote to happen, if only to keep from disenfranchising the voters in these states. It doesn't seem like they did...
Unfortunately Obama fought against the voters (for understandable reasons, but not noble ones). When he gets the noination because of it, he probably will have lost the electoral votes of these two states, and therefore the Presidency. What an exciting new way for the Deocratic Party to screw up another election.
