Republican senator says Senate president is bullying him

Republican Sen. Andrew P. Harris received a letter yesterday from the Democratic Senate president asking him to fire his chief of staff by Friday -- a directive that Harris called "Chicago-style" bare-knuckles politics.

Miller's stated reason for requesting the termination of Kathy Szeliga is that she is a candidate for the House of Delegates this fall and therefore cannot continue to work for the state legislature.

Harris believes Miller's move is a nothing more than a political power play. The outspoken Baltimore County representative, who is running for Frank Kratovil's congressional seat this fall, is pushing a number of measures aimed at scaling back state lawmaker pensions. The Senate this morning refused to give Harris an extra day to make technical fixes to an amendment he hoped to offer that would put lawmakers into a 401k-style pension system.

"The coincidence is stunning," Harris said of the timing of Miller's request. "This has come completely out of the blue."

Miller this morning disputed that the allegation that his request of Harris was about politics. "He's politicizing a personnel matter that I have absolutely nothing to do with," Miller said. He called Szeliga a "good friend" whom he had once asked to work for him.

The Senate president also said he'd received a complaint about the Szeliga situation weeks ago, long before the pension debate emerged. The complaint came from the Democratic Central Committees of Baltimore and Harford counties.

Miller's letter to Harris, a copy of which was obtained by The Sun, states that Harris must terminate Szeliga because she is "in violation of the personnel policy's prohibition against employees of the legislature running for State legislative office." Miller refers to an attorney general's opinion he obtained.

Harris and Szeliga said ethics and human resources officials told them weeks ago that she could keep her chief of staff position until actually filing as a candidate, which she has not done.

From the Maryland General Assembly personnel policy:

"While employed by the Maryland General Assembly an employee may not run for an office in the Maryland General Assembly. Once the employee has filed with the Election Board to run for a state legislative office, the employee must resign his or her position in the General Assembly."

Harris calls the attorney general's opinion bogus and say he is talking with attorneys about his options. He says he won't fire Szeliga.

Although she has not filed with the State Board of Elections, Szeliga has made a number of moves that affirm she is a candidate. She has an official campaign web site and registered a campaign committee last May so that she could begin accepting donations. She'd raised $13,000* as of January.

Harris says there are "different standards for different people" in the state legislature.

A similar situation arose last summer, when Lisa Baugher, a legislative aide for Delegate Rick Weldon, a Frederick County Independent, sought a waiver of the personnel policy.

Baugher, a Democrat, had announced she would challenge Republican Sen. Alex Mooney of Frederick for his seat. Miller and House Speaker Michael E. Busch sought guidance from the attorney general and, after receiving it, told her she wouldn't be granted a waiver.

Weldon has since left his seat. Baugher dropped out of the race, according to the Frederick News-Post, choosing instead to stay on as legislative aide to Weldon's replacement, Del. Charles Jenkins, a Republican.

* Szeliga's campaign account stands at about $43,000 after totaling not only contributions, but loans and ticket sales. A blog for the Maryland Democratic Party has an assessment of what it sees as other problems with Szeliga working for the legislature while running for office.

Miller calls a judge in the midst of redistricting and interferes with the process as the Senate President and HE is still there.

And this should come a surprise to anyone? Miller and Busch have been at the heart of what's wrong with the political scene in MD for far too long. It's time both of those big bags of wind are tossed out on their butts! Good for Andy Harris for his attempt to bring the pension system under some kind of control for MD politicians. It's about damn time!

I agree with James. Are not Senators and House Delegates employees of the legislature? They are allowed to run for political office. I do not see the legality of such a firing.

This is the only bill that frootloop, wingnut harris has ever sponsored that made a lick of sense. Most of the time he is idiot. Lets let him do one thing right in his miserable career.

Constitutional Convention! Impose term limits for the House of Delegates. This would create competition for Senate seats, local races, and even Congressional contests.

I think Andy Harris should be captured with a net, but this stuff is out of hand.

Julie: I suspect all other members donated to charity throughout the year as well. Sounds like a lame excuse to me.

Vote all of out, Harris too. The encumbents are the ones that have ruined this country. We need term limits and we need to get rid of the perks that are associated with holding office. Make it like jury duty. They are public servants and they forget that.

Mike Miller is a crook. He is a self serving pocket stuffing old fashioned crime boss posing as a politician. He is a father of a malpractice attorney who rapes the system for millions while dad makes sure tort-reform never happens in MD. Their will be no doctors in Maryland in ten years. Hopefully Millers cirrhosis specialist will leave the state, too.

OK, now I'm really bugged. This is exactly why the Democrats must go! It's all about slimeball politics to them and not about the people. It wouldn't surprise me one bit if Kratovil wasn't behind it. He's good at hit-&-run tactics, like when he voted for cap&trade without reading it first, then ran for the "Hill" in hiding when we wanted answers.

Every time we, the grassroots people, try to set up many meetings with him and other Democrats in office, we get the royal run-around, then they cancel out at the last minute every time after we schedule our time to go to them....if that isn't called tactics, I don't know what is.

Harris makes himself accessible to the people...I've met him on several occasions (easily) and I, for one, like what he stands for. He's not going to vote for anything that will put my grandchildren further into debt or a health care bill that will put their grandparents in an early grave to name two.

Miller knows that firing Kathy right now will not only detour Harris's efforts against unreasonable pensions that cost taxpayers money but throw a monkey wrench into his efforts for election...what diabolical timing indeed.

I attend AFP and other grassroots organizations meetings and was at the Baltimore County Council Meeting when Gardina, a Democrat, threw a hissy fit over us bieng there to voice our opions about their $54,000-$60,000 lifetime pensions + benefits for their part-time work and stormed out on us after saying he didn't give a "damn" what we thought....typical Democrat.

I know Harris is right and this spending mentality needs to change along with the health care bill loaded with loopholes & higher costs and the jobs bill (what a joke...just another name for reckless stimulus spending) and getting Kratovil and the likes of him out of office and putting Harris and other Reagan Republicans in is the way to go economically, securely & morally now.

Liberals (Democrats) are known for their spending other people's money for greedy purposes in paying back their supporters and sinking the people into so much debt that we become totally dependent on Big Government and turn socialist. The health care bill is a good example of it.

Spending has never solved a depression but made it worse...read history, not just US history, but world history...not the stuff in today's school books that have sytematically dumbed down the population, but true history and you'll see the Republicans have it right.

As far as our nations's security goes, it looks like DC is inviting more terrorism to our shores by giving them the upper hand.

Why don't the Democrats concentrate their efforts on some firing that makes economical sense in DC instead of sending out their heat-seeking missals aimed soley at Republicans...and in this particular case, one who is known to be a favorite and likely to win the election against Kratovil. I could name quite a few more Dems. that need to hit the road for the people's sake.

I guess firing Kathy is part of the Democrat's "job" program. Guess I'll have to make another protest sign.

This smacks of partisanship...the policy clearly states once filed, and she hasn't done that yet. Harris's statement that he donated to charity is laudable, I wouldn't trust the state to spend it wisely either, but like others I suspect that any legislator can produce charity reciepts on demand. Vote them all out an all levels, we don't need term limits, we have the power of the vote.

No, but they are not allowed to fundraise during session like Kathy has been all session long.

If Senator Harris is feeling bullied by MD's laid back ethical rules, he is not ready for federal office.

C'mon people, think about this. The policy forbidding legislative staffers to run for office is in place so that staffers can't shake down their bosses' constituents for campaign donations while those constituents have issues before the General Assembly. Is that so hard to understand? According to the article, the policy was applied to the Dem staffer last year, so why not the GOP one? Also, it's disingenuous for Szeliga to claim she's "not a candidate" when she's already raised $43,000. As Tony C points out, legislators are forbidden to raise money during session. That same reasoning applies to their staffers as well.
